Reporting Misconduct

TITLE IX NONDISCRIMINATION STATEMENT

Title IX of the Education Amendments of 1972 is a federal law that prohibits sex discrimination in education. It reads:

"No person in the United States shall, on the basis of sex, be excluded from participation in, be denied the benefits of, or be subjected to discrimination under any education program or activity receiving Federal financial assistance."

Legal Citation: Title IX of the Education Amendments of 1972, and its implementing regulation at 34 C.F.R. Part 106 (Title IX). Sex discrimination includes sexual harassment and sexual assault.

REPORTING MISCONDUCT

  • Senate Bill 212 (SB212) states: “It is a Texas State Law that requires all employees (both faculty and staff) at a public or private post-secondary institution to promptly report any knowledge of any incidents of sexual assault, sexual harassment, dating violence, or stalking "committed by or against a person who was a student enrolled at or an employee of the institution at the time of the incident."
  • SB 212 has strong penalties for not complying with the law. Employees failing to report incidents of sexual assault can be charged with a Class B Misdemeanor and terminated. If the person intentionally tries to cover up the incident, they could also face a Class A misdemeanor charge. Furthermore, the university itself could also face a disciplinary action as a failure to comply with the bill’s requirements and could incur as much as a $2 million penalty.
